Whitman County BOARD OF EQUALIZATION

Notice is hereby given that the 2013 County Board of Equalization will convene at 10:45 a.m.

on July 15, 2013, in the Whitman County Commissioners’ Chambers, 400 N. Main Street, Colfax, Washington, and will continue in session and adjourn from time to time for a period of not less than three (3) days, and not to exceed twenty-eight (28) days.

Additional meetings will be held on August 5, 12 and 19, 2013 at 10:45 a.m.

Warren Street Reconstruction Project

Sealed bids will be received until 3:00:00 p.m, June 6th, 2013 at the Tekoa City Hall, 419 Washington St. (P.O. Box 927), Tekoa, WA, 99033, at which time the bids will be publicly opened and read aloud.

The project generally consists of the following work:

The project will reconstruct Warren Street from Crosby Street to Leslie Street.

Base Bid Schedule work consists of re-constructing approximately 1,210 linear feet of paved roadway, and constructing or repairing curb, sidewalk, drainage improvements, related appurtenances, retaining walls, and pedestrian ramps.

Fifty four (54) working days will be allowed to complete the work for project.

Each proposal must be submitted on the prescribed form and accompanied by cash, a certified check, cashier's check, or bid bond, payable to the City of Tekoa, in an amount not less than five percent (5%) of the amount bid. The successful bidder will be required to furnish a performance bond and payment bond, each in the full amount of the contract price.

This project will be funded through the Washington State Transportation Improvement Board. The City shall have the right to reject any or all bids not accompanied by bid security or data required by the bidding documents or a bid in any way incomplete or irregular.

Award of the construction contract is contingent upon approval by the funding agency.

The sale will be discontinued and terminated if at any time before 06/17/13 (11 days before the sale date), the default(s) as set forth in paragraph III, together with any subsequent payments, late charges, advances, costs and fees thereafter due, is/are cured and the Trustee's fees and costs are paid.

The sale may be terminated any time after 06/17/13 (11 days before the sale date), and before the sale by the Borrower, Grantor, any Guarantor or the holder of any recorded junior lien or encumbrance paying the entire balance of principal and interest secured by the Deed of Trust, plus costs, fees, and advances, if any made pursuant to the terms of the obligation and/or Deed of Trust, and curing all other defaults.

VII. The Trustee, whose name and address are set forth below, will provide in writing to anyone requesting it a statement of all costs and trustee's fees due at any time prior to the sale.

VIII. The effect of the sale will be to deprive the Grantor and all those who hold by, through or under the Grantor of all their interest in the Property.

IX. Anyone having any objection to the sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to RCW 61.24.130.

Failure to bring such a lawsuit may result in a waiver of any proper grounds for invalidating the Trustee's sale.

X. NOTICE TO OCCUPANTS OR TENANTS - The purchaser at the Trustee's Sale is entitled to possession of the property on the 20th day following the sale, as against the Grantor under the Deed of Trust (the owner) and anyone having an interest junior to the Deed of Trust, including occupants who are not tenants.

After the 20th day following the sale the purchaser has the right to evict occupants who are not tenants by summary proceedings under Chapter 59.12 RCW. For tenant-occupied property, the purchaser shall provide a tenant with written notice in accordance with RCW 61.24.060.
