COLFAX — Whitman County District Court reported the following criminal conviction sentences from March 31 – April 4:

March 31

• Taryn Gural, was found guilty of driving under the influence. Therefore the defendant is sentenced to 364 days of jail, 363 suspended, and a fine of $990.50. Defendant must serve 1 day in jail, and pay a total of $1,654 in fines by March 1, 2024. Defendant may perform community service in lieu of $990.50 by August, 31, 2023, to be credited at the rate of $16 an hour approved in advance by the probation department. Defendant must have supervised probation for 24 months, undsupervised for last 12 months if all essential requirements of the sentence have been completed. Must obtain an expanded alcohol assessment from a Washington State approved agency and file a copy by April 28, 2023, must attend DUI Victim Impact Panel within 3 months. Defendant’s privilege to drive in the State of Washington shall be suspended for 90 days to bbe set by WA Dept of Licensing. Defendant shall be granted a dollar-for-dollar credit applied to fines for any out-of-pocket expenses paid for evaluation, treatment and/or VIP. Defendant may petition for early termination of probation after 8 months and after successful completion of all terms of this judgment and sentence.

• Jacob Long, was found guilty of reckless driving. Therefore the defendant is sentenced to 364 days of jail, 334 suspended, and a fine of $500. Defendant must serve a total of 30 days in jail, and pay a total of $1,143 in fines by March 1, 2024. Defendant may perform community service in lieu of $500 of fines to be credited at the arte of $16 an hour to be approved in advance, and completed by Aug, 31, 2023. Must have no criminal violation of law or alcohol related infractions. Defendant must have supervised probation for 24 months, unsupervised for last 6 months if all essential requirements of the sentence have been completed. Defendant must obtain a substance use disorder evaluation, expanded alchol assessment from a Washington State approved agency and file a copy of the evaluation/assessment by April, 28, 2023. Begin any recommended/appropriate substance use disorder treatment or education within 45 days and file proof of timely enrollment and completion. Must attend DUI Victim Impact Panel within 3 months. Defendant’s privilege to drive in the State of Washington shall be suspended for 30 days to be set by WA Dept of Licensing. Defendant may possess alcohol and be in a bar/tavern for purposes of employment. Defendant may participate in work and school release pursuant to jail rules.

• Cassandra Anderson, was found guilty of driving under the influence. Therefore the defendant is sentenced to 364 days of jail, 334 suspended. Defendant must serve a total of 30 days in jail. Defendant must have supervised probation for 24 months, unsupervised for last 12 months if all essential requirements of the sentence have been completed. Defendant must obtain an expanded alcohol assessment from a Washington State approved agency and file a copy by April, 28, 2023. Begin any recommended/appropriate substance use disorder treatment or education within 45 days and file proof of enrollment and completion. Attend DUI Victim Impact Panel within 3 months. Defendant’s privilege to drive in the State of Washington shall be suspended for 90 days to be set by WA Dept of Licensing. Defendant shall provide proof of completion of anger management course, and a risk assessment with probation to determine whether a mental health or other type of additional evaluation is needed. Mandatory minimum jail is required, an additional 29 days shall begin within 24 hours of any finding of non-compliance with probation after affording defendant all due process.

April 4

• Austin Comstock, was found guilty of negligent driving first degree. Therefore the defendant is sentenced to 90 days of jail, 89 suspended, and a fine of $1,000, $750 suspended. The defendant must serve a day in jail. Unsuspended jail may be converted to 12 hours community service. Jail shall be arranged by the probation department and completed by defendant within 30 days. The defendant has a total of $935.63 in fines due by April 1, 2025. Defendant may perform community service in lieu of $250, to be credited at the rate of $16 an hour and approved in advance by the probation department. Community service must be completed by June, 30, 2023. Defendant must have supervised probation for 24 months, unsupervised for last 12 months if all essential requirements of the sentence have been completed. Defendant must obtain an expanded alcohol assessment from a Washington State approved agency and file a copy of the evaluation/assessment by May 19, 023. Begin any recommended/appropriate substance use disorder treatment or education within 45 days and file proof of timely enrollment and completion. Attend DUI Victim Impact Panel within 3 months. If defendant completes all conditions of probation and no violations have been committed after 24 months, defense counsel may pursue a deferred sentence by providing legal authority convincing the Court a deferred sentence is allowable. Defendant shall be granted a dollar-for-dollar credit applied to fines for any out-of-oocket expenses paid for evaluation, treatment and/or VIP. Defendant may petition for early termination of probation after 12 months and after successful completion of all terms of this judgment and sentence.
