COLFAX — Whitman County District Court reported the following criminal conviction sentences from March 9 to March 16:

March 15

• John Hoyt was found guilty of criminal trespass in the 1st degree, therefore the defendant is sentenced to 30 days of jail, 28 suspended. The defendant must serve 2 days in jail, and no violations of law. Unsupervised probation for 12 months.

March 16

• Michael Titus, was found guilty of DUI, therefore the defendant is sentenced to 364 days of jail, 362 suspended, and a fine of $2,000, $750 suspended. The defendant must serve 2 days in jail, and pay a total in fines of $1,970.88. Defendant may perform community service in lieu of $1,250 of fines, to be credited at the rate of $16 an hour and must be approved in advance by the probation department, completed by Dec. 31, 2023. Defendant must not drive a motor vehicle, and have no criminal violation of law or alcohol related infractions. Supervised probation for 24 months, unsupervised for last 9 months if all essential requirements of the sentence are completed, and obtain an expanded alcohol assessment within 30 days of enrollment, with proof of completion from a Washington State approved agency and file a copy by Dec. 31, 2023. Defendant shall be granted a dollar-for-dollar credit applied to fine for any out-of-pocket expenses paid for eval, ADIS and VIP> Defendant may possess alcohol for the purposes of employment.

• Andrew Lemings, was found guilty of DUI, therefore is sentenced to 364 days of jail, with 363 days suspended, and a fine of $1,000. Must serve 1 day in jail, with total fines of $1,759.44, due by Feb. 28, 2025. Defendant may perform community service in lieu of $1,000 of fines to be credited at the rate of $16 an hour, approved by the probation department and completed by Aug. 31, 2023. The defendant shall not drive a motor vehicle, no criminal violations of law or alcohol related infractions. Supervised probation for last 6 months if all essential requirements of the sentence have been completed. Defendant must obtain an expanded alcohol assessment from a Washington State approved agency and file a copy of the evaluation by March, 31, 2023. Defendant must attend DUI Victim Impact Panel within a month. Defendant’s privilege to drive in the State of Washington shall be suspended for 90 days to be set by WA Dept of Licensing. Defendant shall be granted a dollar-for-dollar credit applied to fine for any out-of-pocket expenses paid for eval, ADIS, and VIP. Defendant may earn up to 10 hours community service for attending any DUI Court program in any jurisdiction in the State. Further, Defendant may earn community service credit for time preparing and delivering any speech to any group on the subject of alcohol, its impact and making positive choice at a 2x rate.

• Austin Cebulske, was found guilty of negligent driving in the first degree, therefore the defendant is sentenced to 90 days of jail, with 89 suspended, and a fine of $1,000, $500 suspended. Defendant must serve a total of 1 day, which can be converted to 8 hours community service. Community service may be done out of county at defendant’s expense. Defendant owes a total of $964.46 due by Feb. 28, 2024. Defendant may perform community service in lieu of $500 of fines to be credited at the rate of $16 an hour and must be approved in advance by the probation department, and completed Aug. 31, 2023.Supervised probation for 12 months, unsupervised for last 6 months if all essential requirements of the sentence have been completed. Defendant must obtain an expanded alcohol assessment from a Washington State approved agency and file a copy by March, 31, 2023. Attend DUI Victim Impact Panel within 1 month. Defendant shall be granted a dollar-for-dollar credit applied to fine for any out-of-pocket expenses paid for eval, ADIS and VIP. Defendant may earn hours community service credit for every time he serves as a designated driver at the rate of 1 hour per ride, or more if more time is expended.

• Mia Murphy was found guilty of negligent driving in the first degree. Therefore, the defendant is sentenced to 90 days of jail, 89 suspended, and a fine of $1,000, $750 suspended. The defendant must serve a day in jail, which may be converted to 8 hours community service. Jail shall be arranged by the probation department and completed within 90 days. The defendant has a total of $732.25 in fines, due by Feb. 28, 2024. Defendant may perform community service in lieu of $250, to be credited at the rate of $16 an hour, approved by the probation department in advance, and completed by Aug. 31, 2023. Defendant must have no criminal violations of law or alcohol related infractions. Supervised probation for 12 months, unsupervised for last 4 months if all essential requirements of the sentence have been completed. Defendant must obtain an expanded alcohol assessment from a Washington State approved agency to be filed by March, 31, 2023, and attend DUI Victim Impact Panel within a month with proof of timely enrollment and completion. Defendant shall be granted a dollar-for-dollar credit applied to fine for any out-of-pocket expenses paid for eval, ADIS and VIP. Defendant may earn hours community service credit for every time he serves as a designated driver at the rate of 1 hour per ride or more if time is expanded. Defendant may petition for early termination of probation after 8 months and after successful completion of all terms of judgment and sentence.
