District Court

COLFAX — The following individuals were sentenced in Whitman County District Court last week:

• Robin Waithaka, first-degree negligent driving. Defendant sentenced to 90 days in jail with 45 days suspended, and a fine of $1,000 with $750 suspended. Defendant will serve a total of 45 days in jail with credit for 2 days served. Defendant must pay fines of $250, criminal conviction fee of $43, public defender fee of $500, supervised probation fee of $600, for a total of $1393. Defendant must have no criminal violations of law or alcohol related infractions. Defendant will have supervised probation for 24 months, must obtain an expanded alcohol assessment and begin any recommended substance use disorder treatment or education within 30 days. Defendant must attend DUI victim impact panel within 3 months, not use or possess any non-prescribed controlled substances or illegal drugs, not use of possess alcohol or marijuana, submit to random alcohol/drug testing, not go to alcohol establishments unless an ignition interlock device is installed.

• Ricardo Lopez Gaytan, first-degree attempted trespass-domestic violence. Defendant sentenced to 90 days in jail with 90 days suspended, and a fine of $1,000 with $1,000 suspended. Defendant must pay a supervised probation fee of $300, public defender fee of $350, with the total fines of $650. Supervised probation ordered for 24 months, unsupervised probation for the last 12 months if all essential requirements of the sentence have been completed, must obtain a substance use disorder evaluation, expanded alcohol assessment, a metal health evaluation and domestic violence perpetrator evaluation. Defendant must have no criminal violations, not use or possess and non-prescribed controlled substances or illegal drugs. Defendant cannot go upon the property of and have no contact with Sandy D. Cearibay Flores.

• Justin Michael Smith, third-degree theft. Court authorized a deferred sentence for 12 months on the following conditions: 90 days of jail with 89 days suspended and a fine of $500 with $500 suspended. Defendant must serve a total of 1 day in jail, with 1 day convertible to 24 hours of community service. Defendant must pay a criminal conviction fee of $43. Defendant must have no criminal violations of law. The defendant must have supervised probation for 12 months and unsupervised probation as soon as all essential requirements of the sentence have been completed. Defendant must attend a theft prevention course, begin any recommended treatment or education within 45 days and file proof of timely enrollment and completion. Defendant may petition the court for a deferred sentence earlier if all affirmative obligations have been completed.

• Ian Neveu, first-degree negligent driving in the first degree. Sentenced to 90 days of jail with 89 days suspended and a fine of $1,000 with $750 suspended. Defendant must serve 1 day in jail which may be converted to 12 hours of community service. Defendant fined $250, a supervised probation fee of $600, DUI cost recovery fee of $ 150.92, for a total of $1,000.92, all payment of fines and costs due by May 31, 2024. Defendant must have no criminal violations of law or alcohol related infractions. Defendant must have supervised probation for 24 months and unsupervised probation for the last 12 months if all essential requirements of the sentence have been completed. Defendant must obtain an expanded alcohol assessment and begin any recommended substance use disorder treatment or education within 30 days, attend DUI victim impact panel within 3 months, not to use or possess any non-prescribed controlled substance or illegal drugs, not use or possess alcohol or marijuana, submit to random alcohol/drug testing, not to go to alcohol establishments, ordered not to drive with a .02 BAC or higher or any active THC in their system for the full length of probation.

• John Q. Lindsey, first-degree negligent driving in the first degree. Defendant is sentenced to 90 days of jail with 89 days suspended, with a fine of $1,000 with $750 suspended. Defendant must serve a total of 1 days in jail, 1 day maybe converted to 12 hours of community service. Defendant must pay fines of $250, criminal conviction fee of $43, Supervised probation fee of $600, with the total of $893, payment of fines and costs due by May 31, 2024. Defendant must have no criminal violations of law of alcohol related infractions. Defendant must have supervised probation's for 24 months, unsupervised probation for the last 12 months if all essential requirements of the sentence have been completed. Defendant must obtain an expanded alcohol assessment, attend DUI victim impact panel, not use or posses any non-prescribed controlled substance or illegal drugs, not use or possess alcohol or marijuana, submit to random alcohol/drug testing and not go into alcohol establishments.

• Mario Figueroa, first-degree negligent driving. Defendant is sentenced to 90 days of jail with 89 days suspended, with a fine of $1000 with $750 suspended. Defendant must pay fines of $250, criminal conviction fee of $43, supervised probation fee of $600, all payments of fines and cost due by May 31, 2024, with the total of $893. Defendant must have no criminal violations of law or alcohol related infractions. The defendant will have supervised probation for 24 months, unsupervised probation for the last 12 months in all essential requirements of the sentence have be completed, must obtain an expanded alcohol assessment, must comply with all treatment recommendations, attend a DUI victim impact panel with, not use or possess any non-prescribed controlled substances or illegal drugs, not use or possess alcohol or marijuana, submit to random alcohol/drug testing, not go to alcohol establishments.

• Haana Bravard, driving under the influence. Defendant is sentenced to 364 days of jail with 362 days suspended with a fine of $2,000 with $750 suspended. The defendant must also pay fines of $1,250, supervised probation fee of $600 and DUI cost recovery fee of $172.40, for a total of $2022.40. The defendant shall not drive a motor vehicle without a valid drivers license and proof of liability insurance, not drive or be in physical control of a motor vehicle with an alcohol concentration of .08 or more or a THC concentration of 5.00 nano-grams per milliliter of whole blood or higher within two hours of driving, shall submit to breath or blood alcohol test upon the reasonable requested of a law enforcement officer, not drive a motor vehicle with out a functioning ignition interlock device. Defendant must have no criminal violations or alcohol-related infractions. Defendant to have supervised probation for 60 months, unsupervised probation for the last 36 months if all essential requirements of the sentence have been completed, must obtain an expanded alcohol assessment and comply with all treatment recommendations. The defendant must attend DUI victim impact panel, not use or possess any non-prescribed controlled substance or illegal drugs, not to use of possess alcohol or marijuana, must submit to random alcohol/drug testing, not to go to any alcohol establishments. Defendant’s drivers license is suspended for 1 year.

• River Medicinehorse, third-degree malicious mischief-domestic violence and violation of domestic violence no contact order. Defendant must serve a total of 12 days in jail with credit for 12 days served. Defendant must pay restitution of $30 to Jeffrey James Rolfsness, $15 domestic violence no contact order violation fee. Defendant will have unsupervised probation for 24 months, with no criminal violations of law. Defendant must comply with the no contact order.

Defendant is also charged with fourth-degree assault-domestic violence and interfering with domestic violence report. The defendant must serve 1 day in jail with credit for 1 day served. Defendant will have 24 months of probation with no criminal violations. Defendant must comply with the no contact order.

• Marcus Jacobson, two counts of second-degree animal cruelty. Defendant is sentenced to 364 days of jail and a fine of $5,000 with $4,000 suspended, 364 days of jail and a fine of $5,000 with $4,000 suspended. Defendant must serve a total of 728 days in jail, the sentence are to run consecutive. The defendant must pay fine of $2,000, criminal conviction fee of $43, probation/monitoring fee of $600, with the total fines of $2,643. Defendant has supervised probation for 24 months, must obtain a metal health evaluation and begin any recommended treatment or education within 45 days. Defendant is prohibited from owning, caring for, possessing or residing with any animals permanently. A violation of this prohibition carries the following penalties: first violation $1,000 civil penalty, second violation $2,500 civil penalty: guilty of a gross misdemeanor for the third and each subsequent violation. Defendant may own a single service animal.
