District Court

COLFAX — The Whitman County District Court reported the following conviction sentences May 17-19:

May 17

·Alejandro Guitierrez, first-degree driving while license suspended, defendant sentenced to 364 days of jail, suspended 354 days; and a fine of $500 with $500 suspended. Defendant must serve a total of 10 days in jail with credit for no days served. Criminal conviction fee of 43, and a monitoring fee of $300, at a total of $343. $300 of this total is converted to community service, which must be completed by August 31.

May 19

·Garrett Horner, minor exhibiting the effects of having consumed alcohol in a public place. Sentenced to a 6-month deferred sentence, with following conditions: 30 days of jail suspended, fine of $500 suspended. Defendant will have to pay $200 deferral, $43 criminal conviction and $300 monitoring fees, with $200 converted to community service at a rate of $14 per hour. Defendant may not violate the law, and will be under supervised probation for 6 months. Defendant must complete an ADIS or VIP program within three months. If all obligations are met, defendant may petition court for deferred sentence at the end of three months.

·Brandi Nazari, driving while under the influence. Sentenced to 364 days in jail with 363 days suspended, a $1,000 fine, $600 probation fee due by May 1, 2024. Defendant may perform community service at a rate of $14 per hour through Dec. 3, 2022. The defendant may not drive without a license and proof of insurance, and will be required to provide a blood-alcohol test should she be stopped by law enforcement. Supervised probation is ordered for 24 months; the last 12 may be unsupervised if all other requirements are met. Defendant’s driving privilege suspended for 90 days. In addition, defendant must attend a DUI victim panel within 3 months, and is prohibited from using or possessing alcohol, marijuana and any illegal drug.

·Ryan Sinclair, driving while under the influence. Defendant is sentenced to 364 days in jail, 362 suspended, and a fine of $2,000, with $750 suspended. Defendant must also pay a $600 supervised probation fee and $128.29 DUI recovery fee. Fines are to be paid by May 1, 2024. Up to $1,250 may be converted to community service at a rate of $14 per hour. Defendant will be under supervised probation for 36 months, the last 18 may be unsupervised if all other conditions met. Defendant must undergo expanded alcohol assessment by June 30 or disorder treatment/education within 45 days, and attend DUI Victim Impact Panel within 3 months. Defendant may not use or possess alcohol, marijuana or illegal drugs, and submit to random alcohol/drug testing. Defendant is prohibited from going to alcohol establishments. Driving privileges are suspended for 1 year. Defendant may petition for early termination of probation after 24 months.
