Pullman man sentenced to 90 days

Napoe R. Mitchell, 42, Pullman, was sentenced to 90 days in jail Nov. 9 in Whitman County Superior Court after he pleaded guilty to amended charges of fourth-degree assault with domestic violence and criminal trespass. Mitchell had originally been charged with burglary.

Mitchell was arrested by Pullman officers and booked into jail here in the early morning hours of Oct. 14.

According to the Pullman Police report, officers responded to a report of a suspected assault at an apartment on Davis Way. The victim told officers Mitchell had showed up at the apartment and ignored her repeated requests to leave. Mitchell had gone to the apartment to get some items which he had left there. The woman told officers she had been struck several times in the confrontation.

The violence was actually reported to police by a neighbor of the victim who said she heard strange noises coming from the apartment next door.

The victim and Mitchell have a five-year-old boy in common, and the youngster gave an account of Mitchell hitting his mother during the assault.

The state prosecutor recommended a 30-day sentence, but Judge Gary Libey opted to sentence Mitchell to the 90-day sentence. The judge told Mitchell he decided to order the longer sentence because Mitchell struck the mother of their child in front of the youngster. He said Mitchell should consider the impact that had on the boy.

A no-contact order was issued. Mitchell will be allowed to go to the apartment to retrieve his personal items after he is released, but he will have to arrange to be accompanied by a standby officer.
