Barone appeals conviction

Ryan A. Barone, 30, Spokane, filed an appeal of his conviction for malicious mischief in the second degree Friday. Defense attorney Steve Martonick filed notice of the appeal and sentence to the State Division Three Court of Appeals at Spokane Friday.

Barone was convicted by a jury March 13. He was charged with tossing a jail food tray into a holding cell toilet and urinating on the floor in two cells. The food from the tray jammed the toilet.

Barone was sentenced to 60 days in jail Friday and also ordered to pay fines and fees totaling $800. He was credited for time served in jail.
