NOTICE OF DETERMINATION OF NONSIGNIFICANCE (DNS) AND A PLANNING COMMISSION PUBLIC HEARING

Whitman County Planning issued a Determination of Nonsignificance (DNS) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following project:

Whitman County is updating its critical areas ordinances as required by the Growth Management Act (GMA). The GMA requires that all cities and counties review and update their planning documents every eight years. The update deadline for Whitman County is December 1, 2013. Planning staff and the Planning Commission have been working on this update for over a year. The ordinances that require review and update are wetlands, fish and wildlife habitat conservation areas, floodplains, aquifer recharge and geologically hazardous areas. As required by RCW 36.70A.106, Whitman County submitted the draft ordinance to the State Department of Commerce on April 22, 2013, for review before adoption.

After review of a completed environmental checklist and other information on file with us, the Planning Office has determined that this proposal will not have a probable significant adverse impact on the environment.

A public hearing will be held by the Whitman County Planning Commission on July 10, 2013, in the Auditorium, first floor of the Whitman County Public Service Building, at 7:00 PM.

NOTICE OF HEARING

A public hearing will be held by the Whitman County Commissioners on July 1, 2013, in their Chambers located in the Whitman County Courthouse, Colfax, WA at 11:00 a.m.

The purpose of the hearing is to receive public comment for amendments to the Whitman County Zoning Ordinance, Chapter 19.03 Definitions, Chapter 19.10 – Agricultural District and the Comprehensive Plan. The proposed change to the Agricultural District code clarifies both the meaning of ‘commercial grain elevators and where ditch cleaning materials from county roads can go.

Two new definitions have been added to the definitions chapter and a change has been made to the Comprehensive Plan clarifying where industrial uses can occur.

Whitman Conservation District Board Supervisor

The purpose of this Election is to elect a Supervisor to the Whitman Conservation District Board for a three-year term.

The eligibility requirement of those interested in becoming a Supervisor is to be an eligible elector, defined as 1) a registered voter in Whitman County, 2) residing within the District boundary, and is 3) a landowner within the District boundary.

The Conservation District Supervisor is a public official who serves without compensation while setting policy and direction for the District, and providing guidance and oversight on activities and projects. There is one monthly board meeting to attend with the possibilities of additional conservation-related meetings throughout the year. VII. The Trustee, whose name and address are set forth below, will provide in writing to anyone requesting it a statement of all costs and trustee's fees due at any time prior to the sale.

VIII. The effect of the sale will be to deprive the Grantor and all those who hold by, through or under the Grantor of all their interest in the Property.

IX. Anyone having any objection to the sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to RCW 61.24.130.

Failure to bring such a lawsuit may result in a waiver of any proper grounds for invalidating the Trustee's sale.

X. NOTICE TO OCCUPANTS OR TENANTS - The purchaser at the Trustee's Sale is entitled to possession of the property on the 20th day following the sale, as against the Grantor under the Deed of Trust (the owner) and anyone having an interest junior to the Deed of Trust, including occupants who are not tenants.

After the 20th day following the sale the purchaser has the right to evict occupants who are not tenants by summary proceedings under Chapter 59.12 RCW. For tenant-occupied property, the purchaser shall provide a tenant with written notice in accordance with RCW 61.24.060.
