NOTICE OF DETERMINATION OF NONSIGNIFICANCE (DNS) AND A PLANNING COMMISSION PUBLIC HEARING

Whitman County Planning issued a Determination of Nonsignificance (DNS) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following project:

Whitman County proposes amendments to its Zoning Ordinances, Chapter 19.50 ñ Flood Management Overlay District and Chapter 19.03 - Definitions. The proposed changes are required to bring the floodplain ordinance into compliance with the National Flood Insurance Program (NFIP) administered by FEMA.

After review of a completed environmental checklist and other information on file with us, the Planning Office has determined that this proposal will not have a probable significant adverse impact on the environment.

A public hearing will be held by the Whitman County Planning Commission on February 1, 2012, in the Auditorium, first floor of the Whitman County Public Service Building, at 7:00 PM.

Copies of the DNS are available at no charge from the Planning Office, Whitman County Public Service Building (2nd Floor), N. 310 Main St., Colfax, WA 99111. Town of Oakesdale, WA solicits interest from consulting firms with expertise in Civil and Structural Design. Consultants will be considered for the following projects, individually.

PROJECT DESCRIPTION

The work to be performed by the CONSULTANT consists of preparing preliminary engineering and PS&E for replacement of Steptoe St. Bridge in Oakesdale, WA with a pre-cast concrete structure. The improvements will involve structural, hydraulic, and civil engineering services.

The Town of Oakesdale, Washington (pursuant of Chapter 61, Laws of 1981 and RCW 39.80) is inviting statements of qualifications and performance information from firms interested in providing professional engineering and land surveying services for the 2012-2013 calendar years in conjunction with Town sponsored projects.

Projects for which services are sought may include water and wastewater system improvement planning and design, street, sidewalk, and storm drainage improvement design, grant and loan applications, environmental documentation, land surveying, geotechnical design; construction engineering and contract administration for projects that may be funded under a variety of federal, state, and local funding programs.

Qualifications must include general firm information, experience resumes for the above listed types of projects or services, experience with state and federal funding programs, resumes of key personnel, a typical project approach, and references. Statements of qualifications will be reviewed and placed on file for the 2012-2013 calendar years, and used as the source from which to select one or more qualified firms from whom a detailed proposal may be requested for any specific project. Purpose and Nature of the Project:

The project will involve raising the lagoon dikes approximately two feet in elevation to provide freeboard for protection of the dikes and augment the capacity of the lagoons. The project will also involve the replacement of an existing flow transfer structure between the two lagoon cells to control levels and flows between the lagoons. Mechanical aeration equipment, along with associated electrical wiring and controls, will be installed in Lagoon #2 to improve wastewater treatment quality, augmenting the aeration equipment recently installed in Lagoon #1.

The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act requirements

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the RE designated office responsible for receiving and responding to comments. All comments received by January 19th, 2012 will be considered by the Town of Rosalia prior to authorizing submission of a request for release of funds.

ENVIRONMENTAL REVIEW RECORD

An Environmental Review Record (ERR) for this project has been developed by the above-named RE. The ERR documents the environmental review for this project and contains all of the required project information. The ERR is on file at Rosalia City Hall, 110 W. Fifth, Rosalia, WA and is available for examination and copying weekdays between 8:00 am and 3:30 pm Monday-Thursday or 10:00 a.m and 3:00 pm Friday.

RELEASE OF GRANT FUNDS

The Town of Rosalia certifies to Commerce that Jenna McDonald in her capacity as (Clerk/Treasurer) consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Commerce’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Town of Rosalia, Whitman County to use State Community Development Block Grant (CDBG) funds.

OBJECTION TO RELEASE OF FUNDS

Commerce will accept objections to its release of funds and the RE’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: a) the certification was not executed by the Certifying Officer of the Town of Rosalia; b) the RE has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the RE has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by Commerce; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.

NOTICE OF TRUSTEE’S SALE

Pursuant to the Revised Code of Washington

Chapter 61.24, et. seq.

I.

NOTICE IS HEREBY GIVEN that the undersigned Successor Trustee will, on Friday, the 20th day of January, at the hour of 10:00 a.m., at the entrance to the Whitman County Courthouse at 404 North Main Street in Colfax, Washington, sell at public auction to the highest and best bidder, payable at the time of sale, the following described real property, situated in the County of Grant, State of Washington, to-wit:

LOT 18, RED TAIL RIDGE SUBDIVISION, Whitman County, WASHINGTON.

which is subject to a Deed of Trust dated April 30, 2008, recorded June 2, 2008 under Whitman County Auditor’s File No. 686823; Assignment of Deed of Trust dated April 30, 2008, recorded June 2, 2008 under Whitman County Auditorís File No. 686824; Assignment of Deed of Trust dated July 14, 2008, recorded August 13, 2008 under Whitman County Auditorís File No. 688442; Assignment of Deed of Trust dated March 25, 2011, recorded May 2, 2011 under Whitman County Auditorís File No. 1285870; Assignment of Deed of Trust dated March 25, 2011, recorded August 8, 2011 under Whitman County Auditorís File No. 706165.

NICHOLAS L. WALLACE has been appointed as Successor Trustee pursuant to appointment thereof dated August 9, 2011, recorded August 25, 2011, under Whitman County Auditorís File No. 706462.

II.

No action commenced by the Beneficiary of the Deed of Trust is now pending to seek satisfaction of the obligation in any court by reason of Borrower's or Grantor's default on the obligation secured by the Deed of Trust.

III.

The default(s) for which this foreclosure is made is/are as follows:

Failure to pay when due the following amounts which are now in arrears:

Interest thereon at the rate of 9.25% per annum

IV.

The sum owing on the obligation secured by the Deed of Trust is:

Principal of $49,450.82; together with interest thereon at the rate of 9.25% per annum as provided in the Promissory Note from the 2nd day of December 2010 and such other costs and fees as are due under the Note or other instrument secured, and as are provided by statute.

V.

The above-described real property will be sold to satisfy the expense of sale and the obligation secured by the Deed of Trust as provided by statute.

The sale will be made without warranty, express or implied, regarding title, possession, or encumbrances on the 20th day of January 2012.

The default(s) referred to in Paragraph III above must be cured by the 9th day of January 2012 (eleven [11] days before the sale date), to cause a discontinuance of the sale.

The sale will be discontinued and terminated if at any time on or before the 9th day of January 2012 (eleven [11] days before the sale date), the default(s) as set forth in Paragraph III is/are cured and the Successor Trusteeís fees and costs are paid.

The sale may be terminated at any time after the 9th day of January 2012 (eleven [11] days before the sale date), and before the sale by the Borrower, Grantor, any Guarantor, or the holder of any recorded junior lien or encumbrance paying the entire principal and interest secured by the Deed of Trust, plus the costs, fees, and advances, if any, made pursuant to the terms of the obligations and/or Deed of Trust, and curing all other defaults.
