COURT RULES IN FAVOR OF BRYAN

Josh Bryan, originator of the now defunct “100 Years of Motorcycles” August events in Rosalia, prevailed in a partial summary judgment filed Wednesday in superior court. The ruling involves Bryan’s suit against the City of Rosalia, Rosalia Chamber of Commerce and others after they ended his role with the rally operations.

After reviewing affidavits, statements and motions from parties involved in the suit, the court ruled the Town of Rosalia breached the licensing agreement it had made with Next Level, Bryan’s company. The court also ruled the amount of damages sustained by Bryan will have to be determined at trial.

The court also dismissed the town’s contention that Bryan failed to honor the contract by failing to hold rallies in 2008 or thereafter. It also said the April 7, 2007, contract Bryan had with the Rosalia Chamber of Commerce is binding.

The court also ruled issues of fact remain to be determined at trial on the number of tickets sold for the August, 2007, rally.

Among filings reviewed by the court were declarations filed by Ken Jacobs, former Rosalia mayor, Nan Konishi and Bryan and affidavits filed by Kelley Messinger and Tina Coe.
