NOTICE OF DETERMINATION OF NONSIGNIFICANCE

(DNS)

The Whitman County Public Works Department issued a Determination of Nonsignificance (DNS) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following project:

Whitman County Public Works 2011 Solid Waste Management Plan which addresses the management and disposal of municipal solid wastes currently generated in the county. The plan pertains to waste generated in the entire county with the facility located at Carothers Road Solid Waste Facility, 252 Land fill Road, Pullman WA 99163, northwest of Pullman in Section 28, T. 15 N., R. 44 E. W.M., Whitman County, Washington.

After review of a completed environmental checklist and other information on file, the Director of Public Works has determined that this proposal will not have a probable significant adverse impact on the environment.

NOTICE IS HEREBY GIVEN that the Whitman County Commissioners have set the date of Monday, August 15, 2011, at 10:30 a.m.

SEEKING WATER CONSERVANCY BOARD MEMEBERS

The Whitman County Commissioners are seeking individuals interested in serving on the Water Conservancy Board. This 5-member board was established in 2001 to assist the Washington State Department of Ecology in processing water right applications and to provide localized service to the county they represent. These boards have been instrumental in helping resolve the State’s 1900 application backlog.

NOTICE OF ADOPTION OF

ORDINANCE

by the

TOWN OF GARFIELD

On April 27, 2011, the Garfield Town Council adopted Ordinance No. 400N. The ordinance grants to the Port of Whitman (the “franchisee”) a nonexclusive franchise to locate, construct, operate, and maintain poles, wires, fiber optic lines, underground cables, and appurtenances (“facilities”) over, under, along and across the Town’s rights of way and public property. The ordinance provides in part:

the term of the franchise will be 25 years;

conflicts between the franchise provisions and the Town’s exercise of its lawful police powers will be resolved in the Town’s favor;

underground facilities location will be subject to review and approval by the Town;

franchisee must relocate its facilities whenever the Town deems it necessary for any governmental purpose;

if the Town grants use of its right-of-ways or public places to others, or if the Town abandons a right-of-way which contains franchisee’s facilities, such action shall be subject to franchisee’s franchise grant;

construction of facilities must comply with applicable laws and building codes, and any property of others damaged by the work must be repaired or restored;

franchisee shall hold the Town harmless for damage to franchisee’s underground facilities occasioned by emergency repairs to the Town’s underground utilities, provided notice reasonable under the circumstances has first been provided to franchisee;

installation of franchisee’s facilities underground shall be preferred to above-ground installation;

the franchise shall not be assigned without the Town’s consent;

franchisee must maintain public liability insurance, and shall indemnify the Town against damages or penalties arising out of any act or omission by

franchisee; and

the ordinance provides procedures for early termination of the franchise in the event of franchisee’s material breach of any terms or conditions of the franchise, or in the event of other occurrences.

An ordinance ADOPTING THE PROPERTY TAX INCREASE FOR COLLECTION IN 2012.

Section 1. The dollar amount of the increase over the actual levy amount from the previous year shall be $580.12, which is an increase of one percent from the previous year, plus an increase of $899.76 which is an increase of 1.55% from the previous year, due to banked capacity. This increase is exclusive of additional revenue resulting from new construction allowed under the provisions of RCW 84.55.010, plus improvements to property, newly constructed wind turbines, any increase in the value of state assessed property, any annexations that have occurred and refunds made.

NOTICE IS HEREBY GIVEN that the Town of Rosalia, will open sealed proposals and publicly read them aloud on or after 10:00 A.M. on Friday, August 19, 2011 at the Rosalia City Hall, 110 W.
