Summary of Work:

In accordance with Section 01100 – "Summary of Work".

Bid Security:

Certified check, bank cashier’s check or bid bond congruent with the Form of Bid Bond as identified in the "Instruction to Bidders" is required to be submitted with each proposal, in the amount equal to five percent (5%) of the total basic bid plus additive alternate bids (if applicable). Make bid security payable to Whitman County; furnish bond executed by a licensed bonding agency authorized to do business in the locality of the Project.

Right To Accept or Reject:

The Owner shall reserve the right to reject any or all proposals and the right to waive any irregularities or informalities in any proposal, subject to the Laws of the State of Washington as pertaining to Public Works, and as may be deemed in the best interest of the Owner. In particular, the Owner reserves the right to reject a proposal of a Bidder who does not attend the Mandatory Site Visit, a proposal, which is not accompanied by the required bid security, and incomplete or irregular proposals, which may exclude or modify any item(s) required by the Bid Document. No proposals will be accepted after the hour(s) set for receipt of proposals as set forth above.

Mandatory Pre-Bid Conference:

A Mandatory Pre-Bid Conference will be conducted at the project site on July 15, 2010 at 10:00 AM (PDT). All Bidders submitting proposals are required to meet with the Owner and Architect at the Level 1 Lobby of the Whitman County Courthouse, 400 North Main Street, Colfax, Washington and retire to the site for a Pre-Bid Conference.

Withdrawal of Proposals:

No proposal may be withdrawn, except with the express permission of the Owner, after the hour set for the opening thereof unless the "Notice of Intent to Award" the contract is delayed for a period of Thirty (30) calendar days.

NOTICE OF DETERMINATION OF NONSIGNIFICANCE AND CONDITIONAL USE PUBLIC HEARING

The Whitman County Planning Office issued a Determination of Nonsignificance (DNS) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following project:

Whitman County Emergency Services proposes to replace an existing 90-foot communications tower and 10-foot x 10-foot shelter with a 160’ communications tower and 10-foot x 16-foot equipment shelter. The site is located in the NE 1/4 of Section 33, Township 20 N., Range 39 E., W.M., Whitman County, Washington on Potts Road, approximately 3/4 mile south of the town of Lamont.

After review of a completed environmental checklist and other information on file with us, the Planning Office has determined that this proposal will not have a probable significant adverse impact on the environment.

A conditional use permit is required for this proposal and a public hearing will be held by the Whitman County Board of Adjustment on Thursday July 15, 2010 in the Auditorium, first floor of the Whitman County Public Service Building, at 7:00 PM. Persons requiring ADA accommodation should advise us of that need in advance.

Copies of the DNS are available at no charge from the Planning Office, Whitman County Public Service Building (2nd Floor), N. 310 Main St., Colfax, WA 99111. COMMERCIAL WIND ENERGY GENERATING FACILITY OPEN HOUSE

The public is invited to attend an open house by First Wind to introduce a proposal to submit an application to build a wind energy facility in Whitman County. The open house is to be held from 4-7 p.m. at the Community Education and Training Center (CETC) building, 123 N. Main Street, Colfax, WA, on Wednesday July 14, 2010.

This meeting is being held in accordance with the Whitman County Commercial Wind Energy Facility code (Chapter 19.61.020(3)).

VII. The Trustee whose name and address are set forth below will provide in writing to anyone requesting it a statement of all foreclosure costs and trustee’s fees due at any time prior to the sale.

VIII. The effect of the sale will be to deprive the Grantor and all those who hold by, through or under the Grantor of all their right, title and interest in the above-described property.

IX. Anyone having any objections to the sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to RCW 61.24.130.

Failure to bring such a lawsuit may result in a waiver of any proper grounds for invalidating the Trustee’s sale.

X. NOTICE TO OCCUPANTS OR TENANTS - The purchaser at the Trustee’s Sale is entitled to possession of the property on the 20th day following the sale, as against the grantor under the deed of trust (the owner) and anyone having an interest junior to the deed of trust, including occupants who are not tenants.

After the 20th day following the sale of the purchaser has the right to evict occupants who are not tenants by summary proceedings under Chapter 59.12 RCW For tenant occupied property the purchaser shall provide a tenant with written notice in accordance with RCW 61.24.060 and/or any applicable Federal Law.
