District Court Filings

COLFAX — Whitman County District Court reported the following criminal conviction sentences from Dec. 14-20:

Joseph Majia Langi, theft in the third degree. Court authorizes a deferred sentence for 12 months on the following conditions, 30 days of jail, suspended 29 days, and a fine of $500 with $500 suspended. The defendant must serve a day in jail convertible to 8 hours community service. The defendant has a total of $343 in fines. $300 of this total is converted to community service at the rate of $15 an hour which must be completed by June, 31, 2023. The defendant must have no criminal violations of law, and supervised probation for 12 months. Defendant must attend a theft prevention course, and begin the recommended education within 45 days and file proof of timely enrollment and completion. Defendant may petition the Court for dismissal of conviction on or after April 1, 2023 if he makes a meaningful contribution to the community that justifies the dismissal. This can be in the form of additional community service, a speech to his team or classmates or by another commitment.

Daniel Gardner, driving under the influence. The defendant is sentenced 364 days of jail with 334 days suspended, and a fine of $3,000 with $1,754 suspended. The defendant must serve a total of 30 days in jail with credit for 2 days served. Unsupended jail of 28 days may be done out of county at defendant’s expense. Jail shall be arranged by the probation department and completed by defendant within 90 days. The defendant must pay a total of $2,138 in fines by Nov. 30, 2025. Defendant may perform community service in lieu of $1,245.50 to be credited at the rate of $15 an hour and must be approved in advance by the probation department. Community service must be completed by Dec. 31, 2023. The defendant is not permited to drive a motor vehicle, and must have no criminal violations of law or alcohol related infractions. The defendant must comply with the rules and requirements of the Department of Licensing regarding the installation and use of a functioning ignition interlock device. The defendant must have supervised probation for 48 months. Unsupervised probation for last 24 months if all essential requirements of the sentence have been completed. Defendant must obtain a substance use disorder evaluation expanded alcohol assessment from a Washington State approved agency and file a copy of the evaluation/assessment by Jan, 13, 2023. Defendant must begin any recommended/appropriate substance use disorder treatment or education within 20 days and file proof of timely enrollment and completion. Defendant must attend DUI Victim Impact Panel within 3 months. Defendant may petition early termination of probation after 36 months and after successful completion of all terms of this judgment and sentence.
