COLFAX — The following individuals were sentenced in Whitman County District Court on Dec. 4 and 11:

Dec. 4

Kaetana Ro Tesla Martinez, 22, solicitation to possess a controlled substance. Sentenced to 350 days in jail, with one suspended; two years of probation; must refrain from possession alcohol and obtain an alcohol/drug evaluation within 60 days.

Dec. 11

Evelyn I Fatz, driving while under the influence, sentenced to 364 days in jail, with 363 suspended. The day in jail may be converted to 15 days of home monitoring. Fined $5,000, with $4,000 suspended. In addition, ordered to pay a $600 probation fee and $43 conviction fee. Defendant may perform community service at a rate of $12 per hour to be credited to his fine. Conditions of sentence include having a valid license, proof of insurance and not be intoxicated if driving. Must serve 24 months probation and complete an alcohol assessment and attend a DUI victim impact panel. She may not possess any non-prescribed controlled substance, alcohol or marijuana. Drivers license is suspended for 90 days.

Nicholas A. Niehenke, physical control, sentenced to 364 days in jail, with 363 suspended. In lieu of one day in jail, he may opt for 15 days of home monitoring. Fined $5,000, with $4,000 suspended. Niehenke must also pay a $600 probation fee and a $43 conviction fee. Defendant may perform community service at a rate of $12 per hour to be credited to his fine. Conditions of sentence include having a valid license, proof of insurance and not be intoxicated if driving. Niehenke wills serve 24 months probation, undergo an alcohol assessment and attend a DUI victim impact panel. He may not possess any non-prescribed controlled substance, alcohol or marijuana. Drivers license is suspended for 90 days.

Julien Potts, fourth-degree assault, deferred sentence for 12 months, including 180 days in jail suspended. Fine of $1,000, $500 suspended, and a probation monitoring fee of $300, plus a $43 conviction fee. Deferred sentence conditions include no violations of criminal law and 12 months of probation. He is not required to undergo alcohol or drug treatment or monitoring. However, if he completes undergoes treatment and monitoring and successfully abides by other conditions, Potts may petition for dismissal on April 11.
