Money still due in 2005 theft case

Darlo Tolan, who was convicted here in 2005 of second degree theft, was signed into jail here Oct. 1 after a warrant was issued for his arrest. The warrant was issued after Tolan failed to appear for an August court date to show cause of why he has not made payments ordered as part of his May 18, 2005, conviction.

Tolan, now 32, was ordered to pay $1,210 at the time of his conviction, but interest charges on the sum put the amount now due at $3,405. That sum was set at the bail amount for his release after he was jailed Oct. 1.

At a Oct. 2 hearing, some of the fees and costs were dropped from the amount due, but he was still ordered to pay the outstanding sum. He was allowed release from jail.

Records of notice to appear in Tolan's case showed notices have been sent to Burley, Idaho, and Mount Vernon, Wash., in addition to a residence in Colfax.

Tolan in 2005 was sentenced to serve 45 days in jail on theft conviction. He had been ordered to begin making $100 monthly payments on the amount due after he completed the jail term.

Two years prior to the 2005 case Tolan was convicted here on charges of burglary and escape.
