Whitman County Planning issued a Mitigated Determination of Nonsignificance (M-DNS) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following project:

Lisa Morse proposes the construction of an approximately 144’ by 100’ pole building that contains a horse riding arena, stalls, tack room, and feed storage on an existing 10 acre parcel. Any recreational building over 4,000 square feet requires a SEPA. The property is located approximately 1.7 miles north of Colton, at 11051 Johnson Road, in Section 23, Township 12 N., Range 45 E., W.M., Whitman County, Washington.

After review of a completed environmental checklist and other information on file with us, the Planning Office has determined that this proposal will not have a probable significant adverse impact on the environment.

The Department of Ecology (Ecology) is making a National Pollutant Discharge Elimination System (NPDES) permit modification in accordance with the provisions of Chapter 90.48 Revised Code of Washington (RCW), Chapter 173-220 Washington Administrative Code (WAC), and the Federal Clean Water Act.

Ecology is removing the requirement to complete a receiving water study from the current permit. This permit modification also removes the requirement that the Town apply to Ecology for funding for their disinfection system upgrades and associated work. Ecology is issuing a draft amended permit and fact sheet amendment and is only accepting comments on the modified portions.

The wastewater, following treatment, must meet the requirements of the Washington State Water Pollution Control Act and applicable regulations for a permit to be issued. A tentative determination has been made on the effluent limitations and special permit conditions that will prevent and control pollution. A final determination will not be made until all timely comments received in response to this notice have been evaluated.

ORDINANCE NO. 356

AN ORDINANCE OF THE TOWN OF Endicott, WASHINGTON,

amending Endicott Municipal Code §6.04.010 and those portions of Ordinance No. 167, §1, which are codified as part thereof and adopting Endicott Municipal Code Chapter 6.10 "Chickens," thereby establishing rules and regulations for the keeping of chickens within the Town.

BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF Endicott AS FOLLOWS:

Section 1. Endicott Municipal Code §6.04.010 and those portions of Ordinance

No. 167, §1, which IS codified as part thereof, are hereby amended to read as follows:

"6.04.010 -At-large Animals. It is unlawful to keep or harbor or allow to run at large any horse, cattle, sheep, swine, goat, rooster, duck, goose, turkey, peacock, guinea rabbit or wild animal, whether or not domesticated, within the Town."

Section 2. The following section is hereby adopted as Endicott Municipal Code Chapter 6.10 the following:

"Chapter 6.10

Chickens

6.10.010 -Chickens -Coop Fees

6.10.020 -Chickens -Maximum Number

6.10.030 -Chickens -Running at Large Prohibited

6.10.040 -Chickens -Care and Treatment

6.10.050 -Chickens -Complaint Process and Violations

6.10.010 -Chickens -Coop Fees. Any person desiring to keep or harbor chickens within the Town of Endicott shall pay an annual non­refundable $15.00 coop fee to the Endicott Clerk/Treasurer.

6.10.020 - Chickens - Maximum Number. No household shall keep or harbor more than 10 chickens at any given time within the Town of Endicott except upon approval of the Town Council. Any person desiring to keep more than 10 chickens may petition the Town Council for approval to keep additional chi.ckens. If the Town Council determines that the additional chickens will not constitute a nuisance, the Town Council may approve the petition subject to such restrictions as it may deem reasonable and appropriate. If the Town Council subsequently determines that the additional chickens constitute a nuisance, it may withdraw approval for the additional chickens.

6.10.030 - Chickens - Running at Large Prohibited. It shall be unlawful for any person to keep or harbor within the corporate limits of the Town of Endicott any chickens unless the same are at all times kept in suitable enclosure meeting at least the following minimum requirements:

(a) All chickens must be kept in a predator-proof four

- sided cage with a top;

(b) Enclosures must be kept in a clean and healthy condition and comply with all local, state and federal laws; and

(c) Enclosures will be no closer than 25 feet from any neighboring primary dwelling and 10 feet from the chicken owners' property line. The Town Council may grant exceptions in cases of irregular shaped property lines or sizes.

6.10.040 - Chickens - Care and Treatment. No owner or keeper of chickens kept within the corporate limits of the Town of Endicott shall cause or allow any of them to be or become malnourished, or subject to abuse or neglect.

6.10.050 - Chickens - Complaint Process and Violations. The process for submitting complaints of violations of this section shall be as follows:

(a) The person making the complaint shall submit a signed, written complaint setting forth a brief description of the violation to the Clerk/Treasurer.

(b) After a signed, written complaint is received by the Clerk/Treasurer, the Clerk/Treasurer shall forward the complaint to the Town of Endicott code enforcement officer who shall investigate the matter and make a determination whether or not a violation occurred within five days of receiving the complaint from the Clerk/Treasurer.

(c) If the code enforcement officer determines that a violation of this section has occurred, he or she shall send written notice to the violator, notifying the violator of the violation and providing a fixed period of time in which to bring the violator's keeping of chickens into compliance with this section of the code. If, after such specified period of time, the violator fails to bring his or her keeping of chickens into compliance with this section of the code, he or she shall be subject to a fine of $250.00.

(d) Any person who receives two fines under this section will be permanently prohibited from owning chickens within the corporate limits of the Town of Endicott."

Section 3. This ordinance shall be in full force and effect five days after it or a summary thereof, is published in the official newspaper of the Town of Endicott as required by law.
