Assenberg attorney files for return of plants

Douglas D. Phelps & Associates, representing Michael Assenberg of Colfax, filed a motion for return of property on Jan. 10.
The property the motion is referring to is marijuana plants that were seized in a raid by Quad Cities Task Force agents in May 2011.
Charges were dismissed against Assenberg last week when Whitman County Prosecutor Denis Tracy filed a motion to dismiss the four felony charges against Assenberg after the marijuana was confiscated. Tracy cited a new interpretation of medical marijuana laws in the state.
